Overview

The Women’s Financial Wellness Center (WFWC) provides Divorce Financial Consulting. The mission is to help alleviate financial vulnerability and improve financial confidence for women going through divorce. WFWC offers coaching, education and consulting based on our signature BRIDGEtm method. The BRIDGEtm method is designed to help manage the divorce process, the people (divorce team) and the positioning. This step-by-step process is offered as a group program and/or private individual sessions as outlined in the Divorce Financial Consulting proposal.


Agreement

The Client wishes to participate in the WFWC Divorce Financial Consulting services and agrees to retain WFWC for the purposes described in this agreement. Now therefore, in considering the mutual covenants described below, the receipt and sufficient of which is hereby acknowledge, the Client and WFWC agree as follows


Services

The WFWC services are designed to meet the Client at the Client’s level of financial education. WFWC builds on the Client’s knowledge to help the Client develop more financial confidence and provide an understanding of the tools available to achieve the Client’s divorce-related financial goals. The Client agrees to engage WFWC to provide the consulting service as described in the personalized Divorce Financial Consulting proposal. Please see the proposal for the details. The services do not include investment advice, legal advice, or tax advice.


Obligation to provide accurate data and information

The Client agrees to provide WFWC with accurate, reliable financial information. Client understands the WFWC will rely exclusively on such information provided. This includes transparency and completeness of information. The Client will work to get official financial statements in lieu of screenshots. Consequently, the Client agrees not to hold WFWC or its CDFA professionals accountable for any errors or omissions in their work product resulting from failure to provide accurate, reliable and complete financial information. Client agrees to use the secure file sharing service provided by WFWC for the safety of personal data. WFWC will not be held responsible for the breach of data if shared via an unsecured channel.


Fee

The initial investment includes access to our signature process, tools, and resources plus anything else included in the proposal. If there is additional work requested that is outside the scope of the original proposal, the Client and WFWC will have a conversation about the options. If additional work is requested from WFWC, the Client may have an opportunity to invest in additional support.

Additional add-on options include:

• 1:1 Strategy Sessions (if not already included in proposal)

• Attendance at mediation

• Expert witness at trial

• Separate property tracings

• Business valuation

• Pension valuation

• RSU analysis

• Qualified Domestic Relations Order


The Client agrees to do the work, invest the time in the process and attend the agreed upon meetings. If any agreed upon private meetings are cancelled at the last minute (or within two hours of the appointment time) and/or there is a no show for the appointment it will be counted as one of the sessions. However, we know emergencies may come up, and the Client may reschedule an appointment (if needed) using the WFWC calendar rescheduling link. The Client understands and agrees that she will not be entitled to a refund in any amount if the client chooses to not use the services described in the proposal.


Agreement Term

The parties agree and acknowledge that the Client’s engagement with WFWC and participation in the services is strictly voluntary and at the parties’ sole discretion. Either the client or WFWC can terminate the agreement for any reason or no reason by providing a 15-day written notice to the non-terminating party. The client is not entitled to a refund of any amount if the client chooses to terminate the agreement. This agreement is good for up to six months. After that time, the Client and WFWC will meet to evaluate the scope of work to determine what (if anything) is still needed to be completed. The Client would have the opportunity to a) expand the scope of work and receive a revised quote and invoice 2) convert to an hourly billing agreement. All invoices for additional services or billable hours will be due within 5 days of receipt. For any invoices past-due invoices, we will apply a 4% convenience fee.


Service Guidelines

When the Client engages with WFWC to provide the services, the Client agrees to observe the following guidelines. The Client will complete any requested forms, to the best of the Client’s ability with information that is current and accurate. The Client will follow the BRIDGE method for gathering, organizing, and labeling documents. The Client agrees to notify WFWC if any of the information provided changes and will provide updated information as expeditiously as possible.


Service Goals

The Client understands and agrees that the goals of the Divorce Financial Consulting services are: · To provide access to the BRIDGE method via the membership portal and live calendar events · To provide guidance to help the client understand issues/concerns, evaluate options and pursue the client’s financial wellness goals · To provide the client with information, education and guidance to allow the clients to make well-informed financial decisions during the divorce process


Expectations


The Client will:

• Show up to the BRIDGE sessions

• Submit questions for the live Q&A sessions

• Learn and apply the BRIDGE method

• Use the secure Box portal for sharing documents

• Use the BRIDGE method for labeling documents

• Request in writing if you would like WFWC to share access to Box with your attorney/mediator

• Commit to working with a mental health professional or coach

• Use the [email protected] to communicate with WFWC (unless upgraded to BRIDGE Elite)

• Conduct themselves in a respectful and kind manner

VIII. Client’s Hold Harmless and Indemnification

The Client understands and agrees that the Client will make all the decisions regarding the Client’s financial resources, divorce process and all related matters. The Client understands and agrees that the Client will hold harmless WFWC owners, directors, employees, consultants, and agents for any legal, tax, investment, banking, or other decisions made, or actions taken by the Client before, during or after the Client’s divorce. The Client understands and agrees that the client is responsible for the Client’s own decisions and actions.

IX. Exclusive Agreement

The Client agrees to provide accurate, timely information to WFWC regarding the client’s financial situation. The agreement for services is exclusive between the client and WFWC and does NOT include the spouse or former spouse of the client for any reason, without the prior written permission to WFWC.

X. Confidentiality

Information provided by the client to WFWC will be considered confidential and will be protected as confidential by WFWC. This means the confidential information will not be shared with any third party without the client’s expressed written consent. Confidential information means 1) information described to WFWC by the client as confidential 2) information marked by the client as confidential 3) other information by the client to the WFWC that should be reasonable be considered as confidential.

Because the divorce process is a judicial proceeding, WFWC could be subject to a subpoena or other court order that requires the disclosure of some or all the client’s information. WFWC will notify the Client of any court order or other process that may require disclosure of Client’s confidential information. WFWC will comply with all valid legal requirements for disclosure of information. The Client understands and agrees that any objection to a valid court or administrative order to disclose the Client’s confidential information must be addressed directly by the Client or the client’s attorney.

Confidential information does not include 1) information that is or becomes publicly known through no fault of WFWC 2) information WFWC had before receiving it form the client 3) information that is disclosed to WFWC by a third party 4) information that WFWC is required to disclosure under a subpoena, court order, administrative order, or another legal obligation.

XI. Coaching Materials Ownership

   

The Client will receive certain materials from WFWC as part of the Client’s divorce financial consulting agreement. WFWC encourages the Client to use the materials as intended to assist with the Client’s financial wellness goals and objectives.

Ownership of all materials provided by WFWC is retained by WFWC. Regardless of their copyright or trademark registration status, WFWC owns and maintains ownership of its materials. Any reproduction or use of WFWC materials without prior written permission is strictly prohibited.

XII. Miscellaneous

Counterparts

This agreement may be signed in one ore more counterparts, each of which shall be accepted by the parties as an original and all of which together shall be accepted as one and the same instrument.

Governing Law

This agreement shall be governed by and construed under the laws of the State of Wisconsin regardless of any applicable law of the conflicts of laws.

Entire Agreement

This agreement contains the entire understanding of the parties regarding the terms described in the agreement. The agreement may not be modified, supplemented, or restricted except by an agreement in writing signed by both parties. Any waiver of rights or failure to act in a specific instance will not be construed as an agreement to waive any rights or failure to enforce the agreement for any other purpose.

XIII. Acceptance

By signing below, the parties agree to the terms as described in this agreement.

This Divorce Financial Consulting agreement, effective as of date signed, is made between [client] and [WFWC].

Client agreement: I hereby acknowledge that I understand all the terms in this agreement and agree to the terms.

In addition, I understand and agree that the decisions I make about my divorce process and my finances are entirely my responsibility. I am responsible for my own actions. I understand and agree that WFWC does not provide legal, investment or tax advice and do not provide counseling or therapy of any kind.
